Guardianship

The Texas Guardianship process usually involves court proceedings for a qualified adult to be appointed to make medical and financial decisions on behalf of an incapacitated adult. The Guardianship process includes taking away the rights of the incapacitated individual and giving those rights to a qualified guardian. Our office can assist you and your family throughout this process.

Special Needs Trusts

Special Needs Trust is a critical estate planning tool for a disabled person. A Special Needs Trusts allows disabled beneficiaries to receive assets without disqualifying the beneficiary from the benefits they receive. A disabled person often relies upon government benefits for various reasons. However, receiving additional assets from an inheritance, child support or a personal injury settlement may result in disqualification from government benefits due to the required financial threshold limits. A Special Needs Trust allows for the assets to supplement, but not replace the government benefits.
